These General Terms and Conditions of Sale and Use are entered into between:

I/ Article 1: Purpose
These Terms and Conditions define the terms of sale of products presented on the website between PALLINI and the Customer. They govern all the steps necessary for placing an order and ensure order tracking between the contracting parties on the Website.
They also govern the conditions of use of the Site by the Internet user.
The products and items offered for sale are described and presented as accurately as possible.
Photographs, drawings, videos, or other product presentations of any kind are merely suggestions and are in no way contractually binding. Therefore, PALLINI cannot be held liable under any circumstances.
II/ Article 2 : Fields of application
2.1 Definitions
Each of the following terms should be understood according to the definition that follows:
· "The Internet user": any natural person visiting the Site.
· "The Customer": any natural person visiting and making a purchase on the Site for their personal use.
· "The Site": the website http://pallini-sport.fr/site/fr/
2.2 Enforceability of the General Terms and Conditions
These General Terms and Conditions apply to the exclusion of all other conditions, including those applicable to sales in stores or through other distribution and marketing channels.
These Terms and Conditions are accessible at any time on the website and shall prevail over any other document, unless otherwise agreed in advance, expressly and in writing by PALLINI.
PALLINI reserves the right to adapt or modify these Terms and Conditions at any time. Such modifications are binding on the customer from the date they are published online and cannot apply to transactions concluded prior to that date.
Each order placed on the Site is governed by the Terms and Conditions applicable on the date of the order. Therefore, only the Terms and Conditions in effect at the time the contract is concluded are binding on the Customer.
2.3 Acceptance of the General Terms and Conditions
Prior to the conclusion of the sales contract, the Customer acknowledges having read, understood and accepted these General Terms and Conditions of Sale, which he confirms by ticking the box "I have read and accept the general terms and conditions of sale" when placing his order.
Users accessing the Site agree to comply with these general terms and conditions, as well as the Terms of Use contained therein.
2.4 Capacity
The Internet user and/or the Client declares that they have the capacity to enter into this Contract, that is to say, that they are of legal age and not under guardianship or curatorship or have the express authorization of their legal guardians.
2.5 Destination
To ensure the availability of our products to all of its customers, particularly during promotional offers, PALLINI reserves the right to refuse to fulfill all or part of an order deemed abnormal, especially with regard to the quantities of products usually ordered by an average consumer.
2.6 Territory
All product offers and delivery terms are valid in mainland France, Corsica, French overseas departments and territories and other foreign countries.
III/ Article 3: Availability
Offers of products, items or services are valid as long as the products are visible and selectable on the Site, and within the limits of available stock.
PALLINI checks the availability of the ordered product(s) and item(s) during order preparation.
In the event of temporary unavailability of the product, PALLINI undertakes to provide it within a maximum period of 30 days from the date of order validation:
- either to send the customer their order, deducting unavailable items, specifying, where applicable, the additional delivery time for these items.
- either to cancel all or part of the order.
IV/ Article 4: Order
All orders imply acceptance of the prices as defined in the article "our prices" and description of the products and items available for sale on the Site.
4.1 Creating a user account
Before finalizing their order, the customer must create a user account. This account will allow them to make purchases and track the progress of their orders.
The customer will necessarily have to fill out a form, containing in particular the following information: title, last name, first name, full delivery address, email, telephone number and password.
This information is necessary for the order to be registered and shipped.
If the customer benefits from a special offer, they must necessarily, in order for the offer to be taken into account, enter the code which will have been assigned to them in the field provided for this purpose, it being specified that a promotional offer is only valid under the conditions determined by it and cannot be combined with any other offer or promotion in progress.
4.2 Ordering and order tracking
4.2.1 Order steps
The order process takes place in 5 steps: Basket validation, Customer identification, Order summary and validation by the Customer, Order validation by PALLINI, and Order dispatch.
To track their order, the Customer logs in to the Site using their credentials (email and password).
To place an order online, the Customer follows these steps:
Step 1 : Shopping Cart Validation
After clicking the "Add to cart" icon, the user verifies the details of their order (product, quantity, price, size, etc.) and can enter any applicable offer code. Then, the user confirms their selection of the product(s) or item(s) by clicking "Confirm my cart".
Step 2 : Customer Identification
The customer logs in: after clicking the "Add to cart" icon, the user verifies the details of their order (product, quantity, price, size, etc.) and can enter any applicable offer code. Then, the user confirms their selection of product(s) or item(s) by clicking "Confirm my cart" and entering their customer account information.
Step 3 : Order summary and validation by the Customer
b. The Customer selects their payment method.
c. The Customer fills in their electronic purchase order, if applicable.
d. The Customer acknowledges and accepts the General Terms and Conditions of Sale.
e. The Customer validates his order, after having checked all the elements constituting his order by clicking on the "order with obligation to pay" button.
Once the order has been confirmed by the Customer and the payment step validated, an informative registration email is sent to the Customer, recalling the entirety of their order and indicating that it has been successfully processed.
Step 4 : Order validation by PALLINI
Following the initial email, a second order confirmation email will be sent to the Customer. PALLINI will then prepare the order for shipment.
Step 5 : Sending the order
In the days following order confirmation, and after verification, the Customer receives an order summary email indicating that the package has been shipped.
4.2.2 Order tracking
At any time, the Customer who has placed an order can obtain information on the tracking of their online order:
- on the Site in the "My Orders" section, in "My Account",
- or by contacting PALLINI using the form provided for this purpose on the Site in the "Contact" section
- or by dialing 02 35 05 35 35 (cost of a local call from France).
The customer's invoice is available on the goods package and can be issued upon request for one year.
Important : The customer must keep their invoice, as this is the only document accepted for exchanges or refunds in store.
By entering their email address and password, the Customer will be able to print the invoice relating to their order.
4.3 Archiving of invoices
Invoices are archived on our server for 10 years. The Customer can access their order details at any time by logging into their account or by contacting PALLINI directly through the "contact" section or by telephone.
V/ Article 5: Our Prices
The prices of products and items on the Site are indicated in Euros and include all taxes in effect on the date of the order. They are guaranteed subject to obvious typographical or printing errors.
PALLINI reserves the right to change prices at any time but undertakes to apply the prices in effect at the time of validation of the order by the Customer.
VI/ Article 6: Payment
The Customer has the option to pay for purchases made on the Site either by PayPal® account or by check, to the exclusion of any other means of payment.
PALLINI has put in place the technical means necessary to secure orders and related payments made on the Site by the Customer.
6.1 Payment by check
6.1.1 Payment Process
When validating their order, the Customer selects the payment method "by check", then must send us the check ( made payable to PALLINI, signed and dated by the customer) to the following address:

The check will be cashed on the day the package is shipped.
6.2 Payment via PayPal® account
6.2.1 Payment Process
When validating their order, the Customer with a PayPal® account enters their email address linked to their PayPal® account and their PayPal® password .
6.2.2 Payment Security
PayPal® encrypts all the information the Customer provides when creating their account. Therefore, no information other than the Customer's email address is shared with PALLINI.
Financial and personal information is automatically encrypted when any sensitive information is sent to PALLINI servers.
For more information on the security of transactions carried out between PayPal® and the Client's bank, PALLINI invites the latter to contact the said company.
6.3 Default of payment
PALLINI reserves the right to refuse to make a delivery or to fulfill an order from a Customer who has not paid in full or in part for a previous order.
Furthermore, in the event of non-payment occurring after delivery of the goods, PALLINI will send the customer a demand for immediate payment and reserves the right to assign its claim or be represented by any third party of its choosing. PALLINI reserves the right to pursue criminal charges for theft in the event of non-payment.
6.4 Miscellaneous
The maximum number of transactions allowed per day is 2. In case of an input error and as a security measure, the Client's ability to pay with their payment method is blocked for 24 hours.
VII/ Article 7: Delivery
7.1 Delivery options given to PALLINI customers
All orders placed by our Customers are delivered to the address indicated by the Customers when placing the order on the Site.
Customers residing in France can select different delivery methods, detailed on the website.
7.2 Delivery charges
For each order, the Customer is asked to pay a flat-rate contribution towards delivery costs, unless they exceptionally qualify for free delivery under certain conditions. An additional transport charge may be requested from the customer upon delivery if the carrier encounters difficulties (difficult access, unloading not nearby). The amount of this surcharge will be equivalent to the cost invoiced by the carrier to Pallini APS.
The amount of the contribution depends on the order amount, the country of delivery and the chosen mode of transport.
The order amount refers to the total amount of the items whose value is indicated on the invoice.
